Terms of Service
Last updated
These terms are the agreement between you and SavvyElf for using the SavvyElf console and service. By signing in to SavvyElf or using it, you agree to these terms and to our Privacy Policy. If you use SavvyElf for a business or other organization, you confirm that you may accept these terms for it, and “you” includes that organization.
The service
SavvyElf is AI customer service software for businesses. It answers a business's customers on the channels the business connects, from the knowledge the business provides, and hands conversations to the business's team when needed. We are improving SavvyElf all the time, so features may be added, changed or removed; if we remove something you rely on, we will tell you in advance where we reasonably can.
Accounts and workspaces
- You sign in with a link or code sent to your email address. Keep access to that mailbox secure: anyone who can read it can sign in as you.
- Each business works in its own workspace. The workspace owner decides who is invited and what each member may do, and is responsible for the members' use of the workspace.
- You must be old enough to enter into a binding contract where you live, and the details you give us must be accurate.
Your data
Your business's data, including its conversations, contacts and knowledge, stays yours. You give us permission to store, process and transmit it only as needed to provide SavvyElf to you, as our Privacy Policy describes. We do not sell it, use it for advertising, or use it to train AI models.
You are responsible for having the right to use the data you put into SavvyElf and for telling your customers how their data is handled, for example in your own privacy policy, including that you use SavvyElf and its AI. Where the law requires your customers' consent for something you set SavvyElf up to do, you are responsible for getting it.
AI answers
SavvyElf's answers are written by AI models from the knowledge and settings you provide. AI can be wrong, incomplete or out of date, even when it sounds confident. You decide what SavvyElf may answer and do, you are responsible for the knowledge you give it, and you should review how it answers, especially for anything with legal, financial, medical or safety consequences.
SavvyElf asks the customer to confirm before any action that changes data in your systems, and hands the conversation to your team when it cannot help. These safeguards reduce mistakes but cannot rule them out.
Acceptable use
You may not use SavvyElf, or let others use it, to:
- break the law or anyone's rights, including privacy, consumer protection and intellectual property rights;
- send spam or messages people have not asked for, or get around the messaging rules of a connected platform;
- mislead people about who they are talking to, impersonate others, or send harmful, abusive or deceptive content;
- collect payment card numbers, passwords or other sensitive data in conversations without a lawful need and the right safeguards;
- probe, attack or overload SavvyElf, get around its limits or security, or access other workspaces;
- copy, reverse engineer or resell SavvyElf, or use it to build a competing service, without our written permission.
Connected platforms and services
When you connect Facebook Messenger, Instagram, WhatsApp, a mailbox, an online store or your own systems, your use of them is also governed by their terms and policies, such as Meta's Platform Terms and the WhatsApp Business Messaging Policy, and you must follow them. Those services are provided by others: they may change, limit or end what SavvyElf can do with them, and we are not responsible for their availability or for what they do with data.
Fees
SavvyElf is free to use while we finalize pricing. Before any charges start, we will publish the prices and tell you in advance, and you will not be charged unless you choose a paid plan.
Availability
We work to keep SavvyElf running and your data safe, including nightly backups, but we do not guarantee that it will be uninterrupted or error-free. We may need to pause it for maintenance or to deal with problems; when we can, we will do so at quiet times or tell you first.
Suspension and ending
You can stop using SavvyElf at any time, and a workspace owner can delete the workspace in the console; its data is then deleted as our Privacy Policy describes. We may suspend or end access for a workspace or account that breaks these terms, puts others or the service at risk, or when the law requires us to. Unless it is urgent or the law prevents it, we will tell you first and give you a chance to fix the problem.
Disclaimers and limits of liability
To the extent the law allows, SavvyElf is provided “as is”, without warranties of any kind, express or implied, including fitness for a particular purpose. To the extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for lost profits, revenue or data, and our total liability for any claim about SavvyElf is limited to the greater of the amount you paid us in the 12 months before the claim and US$100. Nothing in these terms limits liability that cannot be limited by law.
You are responsible for claims by others that arise from your data or from your use of SavvyElf in breach of these terms, and you will cover our reasonable costs of dealing with them.
Changes to these terms
When we change these terms we update the date at the top. If a change is significant, we will tell workspace owners at least 30 days before it takes effect. If you keep using SavvyElf after a change takes effect, you accept the new terms; if you do not accept them, stop using SavvyElf and delete your workspace.
Governing law
These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws rules, except where the law where you live gives you rights that cannot be waived. These terms are written in English; if a translation differs, the English version applies.
